Big Stone County will not provide legal advice for civil law and we will recommend talking with an attorney to answer those questions.

The Sheriff's Office will serve civil process but prior to service we will need the following:

  • Cover letter with who you want served
  • Full name and date of birth if possible
  • Address of service location
  • What papers are being served
  • Address of where you want the papers returned
  • Include enough copies for the service to take place
Fees
  • Mortgage Redemption:  $250
  • Mortgage Foreclosure Sale:  $100
  • Civil Process, Plus Mileage:  $75 + Mileage - Each process up to 3 attempts, $25 each addl at same address
  • Service of Process - Not Found:  $75
  • Eviction Summons - Unlawful Detainer:   $75
  • Writ of Recovery in Eviction:  $75
  • Posting Three Sale Notices:  $75
  • Certificate of Sale:  $75
  • Mechanics Lien Sale:  $75
  • Other Sales:  $75
  • Schedule/Cancel Mortgage Forclosure:  $50
  • Filing Notice of Intent to Redeem:  $100 (Non-Refundable)
  • Execution Levy Collection:  6%
  • Execution Levy Preparation Fee:  $15 (For Bank/Employer)
  • Deputy Time (Standby/Eviction/Inventory):  $75/hour
  • Lockout/Eviction:  $75/hour
  • Seizure Orders/Replevin:  $75/hour
  • Mileage: (IRS Mileage Rate)
